Miscellaneous

These Terms of Use, together with the Privacy Policy and the Social Networking Discussion Rules, collectively reflect the whole agreement that the parties have about the use of the Company or the Tractormonitor Web Sites, and they replace all prior papers, letters, discussions, or other oral or written understanding that was connected to the use of the Tractormonitor Web Sites. These Terms of Use are not the same as the Terms of Use that govern Tractormonitor.com, the web sites of Tractormonitor.com's sub web sites, or the web sites that may link to or from the Tractormonitor.com Web Sites. They are independent and different from those Terms of Use. These Terms of Service will be interpreted according to Delaware law, and Delaware law alone, without regard to that state's choice-of-law provisions, as well as the laws of the United States of America, where applicable. Insofar as the law permits, any disputes arising out of these Terms of Use or connected to the Service shall be litigated in the local or Federal courts situated in the State of Delaware, and by agreeing to these Terms of Use, you submit to the personal jurisdiction and venue of those courts. Any provision of these Terms of Use that is modified or waived in any way does not constitute a waiver or modification of any other provision of these Terms of Use. If for any reason any part of these Terms of Use is deemed to be unenforceable, that provision will be enforced to the utmost degree permitted, and the rest of the Terms of Use will continue to continue in full force and effect regardless of the invalidated provision.
